Introduction
This agreement sets out the terms and conditions under which Roofix Solutions Ltd will provide maintenance services to the customer.
Definitions
- Customer: The individual or business that enters into this agreement.

Payment - Payment Frequency: Payments will be collected 12 times a year by Direct Debit.
- Payment Due Date: The first payment is due [date] and subsequent payments will be due on the same date every two months thereafter.

- Late Payments: If payment is not received by the due date, a late payment fee of [amount] will be charged. Continued failure to make payments may result in the suspension or termination of services.
- Price Increases: Roofix Solutions Ltd reserves the right to increase prices by giving 60 days’ written notice.
Cancellation - Notice Period: The Customer may cancel this agreement by providing 60 days’ written notice to Roofix Solutions Ltd.
- Cancellation Effective Date: Cancellation will take effect at the end of the current monthly payment period following the receipt of the written notice.
- No Refunds: No refunds will be issued for cancellations.
- Forfeiture of Discounts and Charges: Any discounts applied to services rendered will be forfeited upon cancellation. Services already provided will be charged at the full standard rate.
- Early Termination Fee: If the customer cancels the agreement before the end of the two-year contract term, a pro-rated fee based on the number of months remaining in the contract will be charged to cover administrative costs.
- Fee Waivers: Roofix Solutions Ltd may waive the early termination fee in cases of death or other extenuating circumstances, subject to proof of the event.
- Early Termination: Roofix Solutions Ltd reserves the right to terminate this agreement with immediate effect in the event of non-payment or breach of these terms and conditions.
Service Delivery - Service Commitment: Roofix Solutions Ltd is committed to providing the services outlined in the chosen package to the highest standard.
- Response Times:
- Routine Maintenance: Gutter cleaning and roof condition reports will be scheduled annually.
- Storm Damage:
- Basic Package: Roofix Solutions Ltd aims to respond within one week of notification of storm damage.
- Storm Guard Package: Roofix Solutions Ltd guarantees to respond within 48 hours of notification of storm damage, subject to weather conditions and availability.
- Access: The customer agrees to provide Roofix Solutions Ltd with reasonable access to the property to carry out the agreed services.
- Service Standards: All work will be carried out in accordance with industry best practices and relevant regulations.
Limitation of Liability
Roofix Solutions Ltd’s total liability to the customer under this agreement, whether in contract, tort, or otherwise, shall not exceed the total amount paid by the customer for the services in the preceding twelve months.
Roofix Solutions Ltd shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of profits, revenue, or data, arising from this agreement.
Roofix Solutions Ltd shall not be liable for any loss or damage caused by events beyond its reasonable control, including but not limited to acts of God, adverse weather conditions, or equipment failure.
Roof condition reports provided by Roofix Solutions Ltd are not full roof surveys and should not be treated as such. These reports are intended to provide a general assessment of the roof’s condition and are not a guarantee of the roof’s overall structural integrity or lifespan.
Indemnification
The customer agrees to indemnify and hold harmless Roofix Solutions Ltd and its employees, agents, and subcontractors from and against any and all claims, damages, liabilities, costs, and expenses arising out of or in connection with the customer’s use of the services or breach of these terms and conditions.
Force Majeure
Neither party shall be liable for any failure or delay in performance due to causes beyond its reasonable control, including but not limited to acts of God, war, terrorism, civil unrest, labor disputes, and natural disasters.
Intellectual Property
All intellectual property rights, including but not limited to copyrights, trademarks, and patents, related to the services provided by Roofix Solutions Ltd shall remain the exclusive property of Roofix Solutions Ltd.
Customer Obligations
The customer agrees to: - Provide accurate and complete information when entering into this agreement.
- Comply with all applicable laws and regulations.
- Maintain the property in a condition suitable for the provision of services.
- Provide safe and unrestricted access to the property for Roofix Solutions Ltd employees.
Data Protection
Roofix Solutions Ltd is committed to protecting the privacy of its customers. Any personal information collected will be processed in accordance with the General Data Protection Regulation (GDPR).
Customer data will be used for the purpose of providing maintenance services, processing payments, and communicating with the customer.
Roofix Solutions Ltd will not share customer data with third parties without the customer’s consent, except where required by law.
Customers have the right to access, rectify, or erase their personal data.
Complaints Procedure
Customers with complaints should contact Roofix Solutions Ltd in the first instance by email at tom@roofixsolutions.com.
Roofix Solutions Ltd aims to acknowledge receipt of the complaint within 14 days and resolve the complaint within 28 days of the initial response.
If the complaint cannot be resolved to the customer’s satisfaction, the customer may refer the matter to [relevant dispute resolution body, e.g., The Property Ombudsman].
Entire Agreement
This agreement constitutes the entire agreement between Roofix Solutions Ltd and the customer and supersedes all prior or contemporaneous communications, representations, or agreements, whether oral or written.
Governing Law
This agreement shall be governed by the laws of England and Wales.
Photography and Filming
Roofix Solutions Ltd reserves the right to take photographs and/or film the work carried out at the customer’s property for promotional purposes, including but not limited to use on the company’s website, social media, and marketing materials. The customer agrees to allow Roofix Solutions Ltd to use such images and footage without compensation.
